Nebula Streaming Cinema Terms and Conditions
Introduction
These Terms of Use govern your use of this pop-up cinema. By using this pop-up cinema, you accept these Terms of Use in full. If you disagree with these Terms of Use or any part of these Terms of Use, you are subject to refusal of entry.
COVID safety at Nebula
As a condition of the booking process, guests are acknowledging that they will comply with NSW health orders during their time in-cinema.
We strongly suggest patrons follow the 1.5 metre rule and social distance whilst in the cinema foyer areas. Please be aware that physical distancing may not be possible at all times within individual cinema auditoriums.
While we are taking steps to protect the safety and wellbeing of our guests and our staff, COVID-19 is highly contagious and, as with any enclosed space, there is a risk of you being exposed to the disease when you enter the premises. To mitigate any risk of contracting COVID-19, we highly recommend the use of masks whilst visiting the Nebula cinema.
By entering Nebula Streaming Cinema, you acknowledge that you are voluntarily assuming all risks related to your exposure to COVID-19 and that Nebula Streaming Cinema:
- Does not provide any representations or warranties as to the safety of the premises in relation to COVID-19,
- Does not accept any responsibility to you, or any third party, in the event that you or a third party contracts COVID-19 as a result of you entering these premises, and
- To the extent possible under law, otherwise excludes all liability in relation to your exposure to COVID-19 when on the premises.
Access and use
While the snacks and cinema-like set-up is provided by Nebula, due to licensing restrictions, guests are required to have existing subscriptions to streaming services they access. Upon arrival you will be required to log-in using your own username and password. Rest assured our team will log you out at the end of each session should you forget!
Maximum of four people allowed in the cinema at one time
Customers General Obligations
The patron must adhere to the below points and should they breach any points, Nebula reserve the right to cancel, refuse entry or evict the holder of the ticket to the event.
(a) Allow the venue and its agents or servants free access to and egress from all parts of the premises.
(b) Not carry on or allow to be carried on in or at the premises any behaviour or activity, that is in the opinion of the venue dangerous, noxious, offensive, illegal, noisy or objectionable.
(c) Not use or allow the premises to be used for any purpose other than that for which it was designed or make any alternations or additions to the premises without consent.
(d) Endeavour to observe all relevant laws, regulations, notices and orders.
Unforseen Circumstances
If the venue is unable to perform or will be delayed in performing the function or any of its obligations under the Booking Agreement by virtue of any act or event outside of its reasonable control including, but not limited to, cessation or interruption of electricity, water or gas supply, industrial disputes, plant or equipment failure, unavailability of foodstuffs, fire, storm, flood, earthquake, explosion, war, invasion, insurrection, sabotage or regulatory action, the venue reserves the right to terminate the booking and/or function at any time without the venue having any further liability to the customer.
Photography
The customer, on its behalf and on behalf of its employees, officers, contractors, guests, members, patrons, and invitees or any other persons associated with them, consents to, and authorises, the use and reproduction of any photography and/or videography that has been taken of the customer, its employees, officers, contractors, guests, members, patrons, and invitees or any other persons associated with them, on the function day by the venue for publishing or reproducing the images and recordings in any medium, including websites, magazines or brochures, for public relations, promotions, commercial or advertising purposes.
Smoking
Smoking/vaping will be banned within four (4) metres of a pedestrian entry or exit from the venue (the '4 metre law'). Any smoking or vaping must be conducted off the premises and any failure to do so will forfeit rights to access the cinema for your session.
Penalties for non-compliance include:
- An on-the-spot fun of up to $550 for any patron that does not adhere to smoking rules.
Any costs arising from the setting off of smoke detectors, whether by unauthorised smoking, or as a direct result of activity generated by the function, will be borne by the customer unless caused by the actions of the venue or staff.
Damages
The customer will be responsible for any damage or loss sustained to the venue’s premises including any equipment or fittings in the premises, however, caused, by the customer, its employees, officers, contractors, guests, members, patrons, invitees or any other persons associated with them, and will be charged for any repairs or replacement as deemed necessary by the venue.
Marketing
ANKER INNOVATIONS AUSTRALIA PTY LTD, and its affiliates ("Nebula", "our," "we" or "us")collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, and prize suppliers. We may also use the personal information for purposes set out in our privacy policy located on our website (https://au.seenebula.com/policies/privacy-policy). ANKER INNOVATIONS AUSTRALIA PTY LTD, and its affiliates may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. All entries become the property of the ANKER INNOVATIONS AUSTRALIA PTY LTD.
